Pennsylvania's Dog Bite Injury Laws
Pennsylvania has dog bite laws in place. Under Pennsylvania’s state statutes, dog owners face liability for injuries caused by their pets in two situations. One, the animal is classified as a “Dangerous Dog.” A dog receives this label if it has a history of:
- Injuring a person without provocation;
- Attacking a person without provocation;
- Killing or injuring another animal without provocation and while not on its owner’s property;
- Being used in the commission of a crime.
The second scenario where owners face liability for a bite is when they fail to keep their dog confined, either by a fence, a leash, or the effective control of a human being.
But two court verdicts have expanded the application of dog bite liability laws in Pennsylvania, holding owners responsible even when their animals have no history of aggression and the owners had no way of knowing their dog would lash out.
Miller v. Hurst
In this 1982 ruling, the Pennsylvania Superior Court found that a dog owner in violation of the state’s confinement laws may be held liable for injuries caused by their dog, even if the dog had never attacked before and the owner had no reason to believe it would.
Commonwealth v. Hake
This 1999 ruling held that the owner of a dog who attacks and injuries a person on public or private property is liable for damages, even if the dog had no history of attacking humans and had never shown signs of aggression.
These two rulings broadened the scope of liability for dog owners in Pennsylvania and expanded the circumstances under which an owner may be held accountable for injuries caused by their pet.
