What is a Defective drug?
A defective drug is a prescription or over-the-counter medication that can cause adverse and dangerous health consequences, resulting in psychological or physical injury.
Drugs can be defective for a number of reasons.
- Manufacturing errors
- Labeling errors
- Insufficient warnings
- An inherent defect
Review the particulars of your case with an attorney. Your lawyer can work with medical evidence and expert testimony to prove a drug was defective and caused the adverse effects that you’ve suffered.
Types of Defective Drugs
There are a number of drugs currently on the market, or that were recently available to consumers that are dangerous. The FDA has investigated many of these drugs, and some have been recalled.
Below are some well-known drugs that may be dangerous.
- Invokana/Invokamet
- Talcum powder
- Valsartan
- Zantac
The list above does not include every dangerous drug on the market. The FDA Adverse Events Reporting System publishes quarterly updates on serious risks and safety information for drugs.

Hazards of Defective Drugs
The type of harm that a patient may suffer from a defective drug is dependent upon the type of drug taken. For example, some studies – such as those published in the medical journals PLOS One in 2014 and JAMA in 2013 – have found testosterone replacement therapy drugs, often called low-T drugs, may increase risk of heart attack and stroke.
Other drugs, such as Zoloft, may be linked to birth defects when taken by a pregnant woman. Citing a study, the FDA warned that women taking selective serotonin reuptake inhibitors (SSRI) after week 20 of pregnancy were six times more likely to give birth to a baby with persistent pulmonary hypertension.
There may be many other dangerous consequences of drugs, and those who suffer harm should review their cases with a lawyer.
Who’s liable for injuries caused by a defective drug?
The manufacturer of a product, including a drug manufacturer, has an obligation to manufacture a product free from known hazards. Thus, the drug manufacturer may be liable for injuries caused by defective drugs. In the United States, there have been a number of class action lawsuits filed against drug manufacturers.
In other cases, these entities may be liable for injuries.
- Drug distributor
- Healthcare professional who prescribed the drug
- Pharmacy that filled the prescription for the medication
- A hospital
