Our investigation revealed that the driver had received no formal training and the company had no established safety protocols.

Our satisfied clients have given us a 5-star Google review rating and consistently leave feedback like the following:

“Not every day will you find a good and honest lawyer that is truly concerned with helping their clients to the best of their ability. Well, I can say I have found a firm that earned my trust! My family and I have grown to love and respect the staff at Cordisco & Saile LLC for helping me during this difficult time in my life. I can gladly say we won and had a successful case.”

What is a traumatic brain injury?

The Brain Injury Association of America defines a traumatic brain injury as a change in the brain’s function due to a blow or jolt. Traumatic brain injuries are classified according to the mechanism and severity of the injury.

Traumatic brain injury is responsible for more than 30 percent of trauma-related deaths worldwide, according to a study from the University of Virginia. Brain injury survivors often must depend on others for assistance with daily living activities.

Mechanism of Injury

A penetrating brain injury occurs when an object penetrates the skull and pierces brain tissue. A closed traumatic brain injury is non-penetrating and occurs when the brain moves inside the skull in response to a jolt or bump.

Severity

Traumatic brain injuries may be classified as mild, moderate, or severe.

Mild Traumatic Brain Injury

Mild traumatic brain injury is also known as a concussion. A concussion is typically diagnosed through a series of questions by a physician. The early signs of a concussion may include:

  • Brief loss of consciousness
  • Dizziness
  • Confusion
  • Nausea and vomiting

Loss of consciousness does not always occur. If you or someone you know experienced a head injury, take our concussion quiz to learn more about the symptoms.

Moderate Traumatic Brain Injury

If a period of unconsciousness lasts more than a few minutes but less than a day, a moderate traumatic brain injury may be to blame. This type of brain injury is more likely to result in complications and is diagnosed through imaging tests and a neurological examination.

Severe Traumatic Brain Injury

When a period of unconsciousness lasts longer than a day and imaging tests show changes in the brain, the traumatic brain injury may be diagnosed as severe. Blunt force trauma typically results in alterations in consciousness and lifelong disability.

Symptoms and Complications of Traumatic Brain Injury

According to the Brain Injury Association of Pennsylvania, short-term and long-term symptoms and complications of traumatic brain injury may include:

  • Memory loss
  • Attention and concentration difficulties
  • Slowed learning
  • Difficulty with abstract thinking
  • Emotional and behavioral changes
  • Fatigue
  • Headaches
  • Sleep problems
  • Sight or hearing challenges
  • Loss of balance or motor skills

Types of Traumatic Brain Injury

According to Brainline, a nonprofit organization that offers “authoritative information and support to anyone whose life has been affected by brain injury or PTSD,” traumatic brain injury may occur as primary or secondary injuries.

Primary Injuries

A primary injury is the immediate result of a penetrating or non-penetrating impact.

Intracranial Bleeding

Intracranial bleeding occurs in the protective layers of tissue between the skull and brain. An intracranial hematoma occurs when blood clots form in these tissues. Uncontrolled bleeding is known as an intracranial hemorrhage. The most common types of intracranial bleeding are:

  • Epidural hematoma: a blood clot just beneath the skull
  • Subdural hematoma: a blood clot between the brain and the outermost layer of protective tissue known as the dura
  • Subarachnoid hemorrhage: bleeding in the protective layers between the brain and the skull
  • Intracerebral hematoma: bleeding in the brain caused by a ruptured blood vessel
  • Intraventricular hemorrhage: bleeding in the deep cavities of the brain, called ventricles, that produce and store cerebrospinal fluid

Skull Fractures

A skull fracture may be a hairline crack or break. A break can pierce the brain, making the injury a penetrating traumatic brain injury. If the break occurs at the base of the skull, leakage of cerebrospinal fluid may result.

Contusions

A contusion is a bruise on the brain. During a jolt or sudden blow, the brain may be injured at the site of impact and on the far side of the skull if the brain bounces to the opposite side of the cranium. This is known as a coup-contrecoup injury.

Diffuse Axonal Injury

Diffuse axonal injury is a serious injury that occurs when the brain twists and tears while moving inside the skull. According to the Brain Injury Association, this often results from rapid acceleration and deceleration, wherein the head moves at high speeds and abruptly stops while the brain continues moving. People with diffuse axonal injury often have trouble with memory and rapid mental processing skills. In severe cases, it can cause coma or death.

Secondary Injuries

A secondary brain injury occurs when the brain responds to the initial injury. For example:

  • Hypoxic brain injury: insufficient oxygen
  • Anoxic brain injury: complete lack of oxygen
  • Ischemia: insufficient blood flow to the brain
  • Hypotension: reduced blood pressure, often as a result of blood loss
  • Cerebral edema: swelling of the brain, resulting in intracranial pressure
  • Hydrocephalus: the buildup of fluid in the ventricles of the brain
  • Second impact syndrome: brain damage from a second impact before the first brain injury has healed, resulting in more significant damage than if the initial brain injury were not present

Causes of Traumatic Brain Injuries

The most common causes of traumatic brain injuries are:

Sadly, elder abuse occurs frequently in nursing homes. Falls account for 35 percent of all traumatic brain injuries and cause more than half in children ages 0 to 14 and adults 65 and older.

Occupational brain injuries often occur on Bucks County construction sites due to falls, being struck by or against objects, and falling debris.

What is a nontraumatic brain injury?

Nontraumatic brain injury occurs when the brain is damaged through internal processes rather than a direct impact. This may result from:

  • Medical malpractice
  • Exposure to toxic substances
  • Electrocution
  • Near-drowning
  • Birth injuries

Nontraumatic brain injury is often precipitated by a lack of blood or oxygen in the brain.

Do I need an attorney if I sustained a brain injury in Bensalem?

You will need an attorney to navigate the legal system and guarantee the insurance company treats you fairly. The insurance company may offer you a settlement, but you should not accept this offer until after an experienced brain injury attorney has calculated your lifetime costs.

The Bensalem personal injury lawyers at Cordisco & Saile consult life care planners and financial experts so every case is accurately valued. We pursue every avenue available to ensure you recover maximum compensation.

Compensation for Bensalem Brain Injury Victims

You may be able to recover economic, non-economic, and punitive damages when you have sustained a brain injury because of someone else’s negligence.

Economic damages cover verifiable monetary losses including medical expenses, lost wages, and property damage. When calculating these costs, your long-term disability status is considered. If your earning capacity is permanently reduced, you may be entitled to recover lifetime lost wages.

Non-economic damages are awarded as compensation for pain and suffering, which may include:

  • Disability
  • Loss of bodily functions
  • Loss of enjoyment of life
  • Loss of society

If the at-fault party’s injurious conduct was especially egregious, the court may award you punitive damages as punishment.

Am I entitled to compensation for the wrongful death of a loved one who sustained a brain injury?

If your immediate family member has tragically passed away after sustaining a brain injury, your family may be entitled to file a wrongful death lawsuit in Bucks County and pursue the following economic and non-economic damages:

  • Medical expenses of the deceased
  • Funeral expenses
  • Lost income of the deceased
  • Loss of companionship
  • Loss of parental guidance
  • Pain and suffering of the deceased

Punitive damages are also available. Pennsylvania limits punitive damages in wrongful death cases to double the total amount of economic and non-economic damages.

When should I contact a lawyer?

It is important to contact a Bensalem head injury lawyer promptly after becoming injured. Early involvement ensures your attorney has access to evidence while it is readily available and to witnesses before they forget important details.

It will also give your attorney time to prepare the strongest case possible before the brain injury statute of limitations expires. This occurs two years after injury, with some exceptions.

How is liability established in a brain injury case?

Liability is established by proving the following four elements of negligence exist:

  • Another party owed you a duty of care.
  • The party breached that duty of care.
  • You suffered an injury because of the breach.
  • The breach of duty is the proximate cause of injury.

During your case investigation, the experienced brain injury attorneys at Cordisco & Saile will ascertain the cause of your accident and identify all liable parties, which may include one or more of the following:

  • A property owner
  • A vehicle driver
  • A trucking company
  • The manufacturer of defective products
  • An employer
  • Workers’ compensation
  • The Township of Bensalem or another government entity
  • A health-care provider

How much does a Bensalem brain injury lawyer cost?

Cordisco & Saile offers a contingency fee agreement, which means clients pay nothing upfront. We only collect fees after we successfully recover your compensation. This ensures that accident victims have access to legal counsel with the resources to successfully stand up to insurance companies.
