Pennsylvania law requires all drivers to have car insurance, but some drivers forgo this important coverage. If you are involved in an accident with an uninsured motorist, you can be left in a difficult situation, with mounting medical bills and painful injuries. That’s where our Pennsylvania uninsured motorist accident lawyers come in.

If you or someone you love has been injured in an accident with an uninsured motorist, Cordisco & Saile LLC can help you navigate your legal options and pursue compensation. People come first at our law firm, and you’ll notice the difference from the moment you contact us.

Why Hire Our Pennsylvania Uninsured Motorist Attorneys

Even though insurance might cover an uninsured motorist accident, the insurance company will likely refuse to offer the full amount you’re owed. Insurers are motivated to protect their bottom line. Therefore, you’re likely entitled to more money than the insurance company initially offers, and extensive negotiations may be necessary to get what you deserve.

When you turn to Cordisco & Saile after an accident with an uninsured motorist, we’ll explain your insurance coverage and handle all interactions with the insurance company. Our Pennsylvania uninsured motorist attorneys will identify all the applicable insurance coverage, investigate, and gather strong evidence for the at-fault driver’s liability and the extent of your damages. We’ll then present that evidence to the insurance company and demand a fair settlement.

For over 30 years, our nationally recognized team of personal injury attorneys has advocated for Pennsylvanians, recovering over $100 million for our clients. We know the local court system in Bucks County and beyond, and we’re ready to put our experience to work for you.

Our Reviews Speak for Themselves

At Cordisco & Saile, we’ve achieved results for countless accident victims just like you. Our attorneys have over 400 five-star reviews from satisfied clients throughout Pennsylvania, including the following testimonials:

What Damages Are Available for Uninsured Motorist Claims?

The damages you can receive for an uninsured motorist claim in Pennsylvania depend on the type of insurance coverage you use. Since Pennsylvania is a no-fault state, you must submit a claim with your insurance carrier for benefits, regardless of who caused the collision. You can receive compensation up to the limits of your personal injury protection, or PIP, benefits for your medical expenses. If you have income loss coverage, you can also receive compensation for lost wages.

Your uninsured motorist coverage will kick in if your damages exceed the policy limit and the uninsured driver is at fault for the accident. Uninsured motorist coverage pays for a broader range of damages than PIP, including medical expenses, lost wages, and pain and suffering.

Each uninsured motorist claim is unique, and results vary based on the circumstances. However, our attorneys can maximize how much you can get from an uninsured motorist claim.

Here are a few examples of high-value motor vehicle accident settlements we’ve achieved for our clients:

  • $10 million for a first responder injured in a truck collision
  • $2.47 million for a man injured by an armored car
  • $1.37 million for a Bucks County car accident victim
  • $1.17 million for a couple injured by a drunk driver

Proving Fault After an Uninsured Motorist Accident

PIP coverage doesn’t require you to prove fault. However, you’ll need to prove the uninsured driver’s negligence caused your injuries if you want to use your uninsured motorist coverage. Our attorneys can investigate the accident and gather strong evidence to prove the uninsured driver’s fault, including:

  • Police reports
  • Witness testimony
  • Expert opinions
  • Surveillance and dashcam footage
  • Electronic data, such as phone records

We’ll also prove that the other driver’s negligence directly caused your injuries. Our Pennsylvania car accident lawyers will make a compelling case for the accident’s impact on your life and why you deserve full compensation for your damages.

"When someone chooses Cordisco & Sale to represent them, they've made one of the best choices of their life in a terrible time. Pennsylvania Car Insurance Requirements

Under Pennsylvania law, drivers must carry the following minimum car insurance coverage:

  • Bodily Injury Liability: $15,000 per person, $30,000 per accident
  • Property Damage Liability: $5,000
  • Medical Benefits, or PIP: $5,000

Most insurance companies in Pennsylvania offer optional coverage options such as uninsured and underinsured motorist coverage, collision coverage, comprehensive coverage, and accidental death benefits. Our uninsured motorist accident lawyers in Pennsylvania have a deep understanding of these various types of insurance coverage. We can advocate for the maximum compensation available under your specific policy and investigate other potential sources of financial recovery.

What If I Don’t Have Uninsured Motorist Coverage?

If you don’t have uninsured motorist coverage, you’ll still receive some compensation through your mandatory PIP coverage. However, your damages may significantly exceed your PIP policy limits. In that case, you may pursue a direct lawsuit against the at-fault driver. Your health insurance may also cover some of your medical expenses.

How Long Does It Take to Settle an Underinsured Motorist Claim in Pennsylvania?

There’s no set timeline for settling an uninsured motorist accident claim in Pennsylvania. However, these claims can take longer than other types of car accident claims. Resolving such claims can take several months to more than a year.

You must first exhaust all other forms of insurance coverage to receive uninsured or underinsured motorist compensation in Pennsylvania. You may only use your uninsured motorist coverage after you’ve exhausted your PIP and any applicable liability coverage. Thus, it can take longer to resolve an uninsured motorist accident case. Insurance companies often drag these claims out in the hopes that you’ll settle for a lower amount, but we add pressure to reach a fair resolution as soon as possible.

“One of the biggest questions we always get asked is what's going on with my case? Why's it taken so long? Well, in some of these situations and most of them, it's not us, it's not you, it's them, the insurance company. The insurance company is designed to drag their feet and to prolong the entire process. But why has it taken so long? Well, the majority of these insurance companies have about 10 to 15 to 30 individuals that are looking at a particular region's case. Those caseloads could get up to the hundreds, sometimes even more, and now they can't just look at these cases, they have to look at the documentation that we provide the medical records, and they're not just handed over the money. They're fighting tooth and nail to make sure that they can slow the process and delay you getting paid.”

How Long Do I Have to File a Claim Against the Uninsured Driver?

You must file a lawsuit against an uninsured driver within Pennsylvania’s statute of limitations, which is usually two years from the accident date. However, an uninsured motorist claim under your own coverage is different. Pennsylvania law treats uninsured motorist claims as contract claims, which must be filed within four years of the breach of contract. In the case of an uninsured claim, that clock generally begins to tick when the insurer refuses to pay the claim.

You may lose your right to seek compensation if you miss this deadline, so act quickly. When you come to us, we’ll start building your case right away to avoid missing the statute of limitations.
